Applicability of Terms and Conditions

  1. These General Terms and Conditions apply to contracts for the temporary rental of holiday apartments for accommodation, as well as all other services and deliveries provided by WroclawGuide to the guest. Services by WroclawGuide are provided exclusively based on these terms.
  2. Subletting or further renting out the apartment and using it for purposes other than accommodation require our prior written consent.
  3. Guest’s terms and conditions apply only if agreed upon in advance. Deviations from these conditions are only valid if confirmed by us in writing.

§ 1 Definitions

  • “Holiday apartment”, “we”, “us”, or “our” refers to the apartment operated by Ewa Kierach (VAT exempt as per article 113, §1 VAT Act) and Mirko Seebeck (VAT exempt in Poland as per EU SME scheme with IdNr. DE342359013-EX), pl. Jana Pawla II 28/7, 50-043 Wroclaw, Poland.
  • “WroclawGuide” refers to our website: www.wroclawguide.com
  • “Services” includes all services offered by WroclawGuide, including receiving booking/payment info, managing reservations, and customer support.
  • “Customer” means:
    a) the person registering in their own name, or
    b) the organization on whose behalf the person registers.
  • “Customer account” is the account created on our website to access services.
  • “Property” refers to all types of accommodations listed and offered through our services.
  • “Content” means text, graphics, images, music, software, audio, video, or other data.
  • “Customer content” refers to content provided by the customer while using our services.

§ 2 Booking / Booking Confirmation

All booking requests must be made via our website (www.wroclawguide.com) or email (info@wroclawguide.com). Other booking methods will not be considered.

If the apartment is available, a written booking confirmation and payment confirmation will be sent via email. The booking becomes legally binding upon receipt of the confirmation and payment (see § 3).


§ 3 Payment Terms

The booking becomes valid once payment is received. Full payment (100%) is due within 2 days of receiving booking documents. Failure to pay on time allows WroclawGuide to cancel the booking. Non-payment counts as a cancellation, allowing the property to be rebooked.

No extra charges for water, energy, or waste will be applied.


§ 4 Arrival and Departure

  • Check-in is from 3:00 PM. Guests will receive key handover instructions via phone or email before the arrival. Upon request and prior agreement, late Check-out might be agreed.
  • Check-out is by 11:00 AM. Late departures without prior agreement will incur charges of one additional day (calculated based on the average price per night for the whole stay), upon request and prior agreement, late Check-out might be agreed.

If the guest does not arrive by midnight on the arrival day and provides no notice upfront, the booking is considered cancelled. Re-rental by WroclawGuide is permitted in such case. No refunds are given for early departure.

The apartment shall be left broom-cleaned. Dishes and glasses should be cleaned and stored; the fridge emptied. Additional cleaning charges may apply if not followed.


§ 5 Holiday Apartments

The apartment is provided clean and fully equipped. Any defects must be reported immediately.

Guests are liable for damage caused by them, including broken items, damage to floors or furniture, or others.

Lost keys, or remote controls (including remote control for the gate of the underground parking) will be charged with a penalty of 250 EUR.

Furniture must not be moved. Guests are also liable for damages caused by their companions.

Misuse such as subletting, overcrowding (above the booked number of people), or disturbing the peace may lead to immediate termination of the contract with no refund, in addition a penalty of 500 EUR is agreed.


§ 6 Pets

Pets of any kind are not allowed. Unauthorized pets may incur a cleaning fee of up to €300.


§ 7 Stay

Only registered guests may stay in the apartment. Additional guests incur a €30 per person/night fee. WroclawGuide may terminate the contract if this is violated.

Subletting and sharing the apartment with third parties is not permitted. Acceptance of the terms and house rules is confirmed upon payment.

Violations may lead to immediate termination with no refund or compensation.


§ 8 Cancellation by the Guest

Cancellations must be made in writing. The following cancellation fees apply:

  • Up to 30 days before arrival: 10% of the agreed price
  • Up to 21 days before arrival: 60% of the agreed price
  • Up to 10 days before arrival: 90% of the agreed price
  • 5 days before or no-show: 100% of the agreed price

§ 9 Cancellation by the Host

If we must cancel due to force majeure, illness, or other unforeseeable events, liability is limited to a refund. No compensation for travel or hotel costs will be provided.


§ 10 Liability of the Host

WroclawGuide is liable for the proper provision of the apartment. No liability for outages of utilities or force majeure.


§ 11 Internet Access via WLAN

Guests may use the apartment’s Wi-Fi during their stay. Third-party use is not allowed.

WroclawGuide does not guarantee availability or reliability. We may limit or revoke access if misuse is suspected. Access to certain sites (e.g., violent, pornographic, or paid services) may be blocked.

§ 11.1 Access Data

Login credentials must not be shared. Granting access to third parties requires our written approval and identity verification of the third party. Guests must keep login credentials secret. WroclawGuide may change passwords at any time.

§ 11.2 Risks of WLAN Use, Limitation of Liability

Guests are informed that internet access is unsecured and use is at their own risk. There is no virus protection or firewall. We are not liable for damage to guests’ devices unless caused intentionally or by gross negligence.


§ 12 House Rules, General Rights and Duties

  1. Quiet hours are from 10:00 PM to 6:00 AM. TV/audio shall be at room volume.
  2. When leaving, windows and doors must be closed.
  3. Smoking is strictly prohibited. Violations may incur a €500 cleaning fee.
  4. A private parking space may be booked (fee applies). Available from 3:00 PM on arrival day until 11:00 AM on departure day. Early arrival or late departures require prior agreement.
  5. Use of playground is at guests’ own risk. Parents are liable for their children.
  6. Decoration is not allowed. Any damages caused by decorations are the guest’s responsibility.
  7. WroclawGuide has the right to access the apartment at any time, especially in emergencies. Guests will be notified unless impossible or unreasonable.

§ 13 Jurisdiction

The local court in Wroclaw, Poland, shall have jurisdiction over disputes arising from this contract.
